CONDITIONS OF SALE
These conditions govern the sale of products through the website tricoafro.it and braziliancurly.it (the “Site”).
The TRICOAFRO Site is owned by BRAZILIAN CURLY SAS, with headquarters in Milan, Viale Andrea Doria, 28, tax code/VAT number 11509720964.
Product information, availability and prices
All information about the Products displayed on the Site, including characteristics, images, videos and information sheets are provided to BRAZILIAN CURLY SAS by the relevant manufacturers, or are reproduced based on information published by the manufacturers themselves. BRAZILIAN CURLY SAS may modify the information without the need for prior notice. The images and videos are provided for information purposes and may differ from the appearance of the Product delivered, following possible variations in labels, wrapping or packaging by the manufacturer. All prices of the Products displayed on the Site are inclusive of VAT, and may be subject to periodic changes without notice. Shipping costs are borne by the customer and are indicated separately from time to time and also highlighted when sending the purchase order.
If the value of the product is clearly different from normal and there are no indications of discounts and/or promotions in progress on that item, the anomalous price is due to a system error: in this case, BRAZILIAN CURLY SAS reserves the right to not to accept the order (complete and/or partial), informing the customer and if necessary to return the sum paid (complete and/or partial).
Purchase methods
The customer will be able to proceed with the purchase of one or more Products shown on the Site, as described in the relevant sections, by selecting them from time to time and adding the desired quantities to their shopping cart. Once the desired items have been selected, a screen will be displayed for sending the order indicating all the data entered by the customer, who will be required to verify its correctness, as well as the shipping costs. The customer will be able to select the solution and preferred delivery methods. In order to proceed with sending the purchase order, the customer must pay for the ordered Products and delivery costs, following the instructions indicated on the site. BRAZILIAN CURLY SAS will send a communication of acceptance and confirmation upon receipt of the order by the customer, to the e-mail address communicated by the customer. BRAZILIAN CURLY SAS reserves the right, at its sole discretion, not to accept, even partially, the purchase order, without any right, compensation and/or compensation of any nature and for any reason being accrued in favor of the customer. By sending the communication of acceptance and confirmation, an order number will be assigned which must be used for any further communication with BRAZILIAN CURLY SAS in relation to the order.
Payments
The customer will be able to purchase the Products online and make payments using the methods validated and described on the site, following the instructions indicated for the purchase procedure.
Online payments will be made in complete security since all the information necessary for payment will be forwarded, via encrypted protocols, to the payment institution to which remote electronic payment services are entrusted by BRAZILIAN CURLY SAS, without the possibility of access from part of third parties. It is understood and the Customer acknowledges and accepts that BRAZILIAN CURLY SAS will execute the contract and proceed with the shipment of the ordered Products only after receiving confirmation of full payment of the price and delivery costs made by the customer.
Shipping and delivery of products
For the delivery of the Products, BRAZILIAN CURLY SAS uses couriers and shipping companies that are leaders in national and international transport. The Products may be shipped throughout Italy and the estimated delivery time is approximately within 24 – 48 hours from the moment BRAZILIAN CURLY SAS receives confirmation of full payment for the Products and delivery costs.
Deliveries are normally made on working days, during office hours, from 9am to 6pm. It is possible to customize the delivery methods of the products by contacting Customer Service.
Shipping costs are the responsibility of the customer, unless otherwise indicated. Shipping rates and delivery methods are shown in detail at the time the purchase order is sent and vary based on the quantity of Products ordered and the delivery method selected by the customer.
Right of withdrawal
In compliance with the provisions of the Legislative Decree. lgs. 206/2005, the customer, if a consumer, may withdraw from the sales contract, without having to specify the reason and without penalty, within 14 working days from the date of delivery of the purchased Products. To exercise the right of withdrawal, the customer must send, within this period, an email to Customer Service in**@************ly.it, indicating:
(i) the order number;
(ii) the invoice number, if requested at the time of ordering;
(iii) the Products for which you intend to exercise the right of withdrawal;
(iv) your bank details for the refund (in the case of payment made by bank transfer).
The customer must wait for a communication from BRAZILIAN CURLY SAS authorizing the return of the Products. Within 14 working days of receiving such communication, the customer must send, at his expense, the Products for which the right of withdrawal has been exercised to the address communicated by BRAZILIAN CURLY SAS. Within 10 working days of receiving the goods, BRAZILIAN CURLY SAS will refund the Products subject to withdrawal, excluding shipping costs. The shipment and the means used for the return will be at the care and expense of the customer. The customer cannot be compensated if the Products are lost or damaged. BRAZILIAN CURLY SAS reserves the right to not accept the return of products that are not intact, damaged or tampered with, returning them to the customer with an increase in transport costs.
Damaged, non-compliant products or delivery errors
Upon receipt of the Products, the customer is required to verify that they correspond to those indicated in the purchase order and that the packaging is intact and undamaged.
In the event of errors in the delivery of the Products, packaging that is not intact and parcels or packages that are clearly damaged, the customer is required not to collect the Products, immediately notifying the reasons for this to the carrier, as well as to Customer Service (by telephone +39 3407238912 or by email in**@************ly.it) no later than 48 working hours following the time of delivery of the same. BRAZILIAN CURLY SAS will proceed to verify what the customer communicated to it and subsequently contact the latter in order to agree on the methods and terms for replacing the Products or refunding the price.
Even if the packaging is intact, the Products must be immediately checked by the customer, who is required to report any errors and/or other anomalies by contacting Customer Service within 8 days of receiving them.
Privacy
The processing of personal data provided by the Customer takes place in accordance with Legislative Decree no. 196 of 2003. The complete information on the processing of the aforementioned data, without acceptance of which it will not be possible to proceed with any purchase, is reported in full on the site and is accessible from the link.

These conditions are subject to Italian law.
